Section 504 Information
Section 504 of the Rehabilitation Act of 1973 is a federal civil rights law that prohibits discrimination against individuals with disabilities. It applies to any school which receives federal funds. The intent of this law is to provide students with disabilities equal access to educational programs, services, and activities. Students with disabilities may not be denied participation in school programs and activities solely on the basis of disability.
Section 504 is a nondiscrimination law. Section 504 covers any person who has a mental or physical impairment which substantially limits one or more major life activities, anyone who is discriminated against based upon a record of such impairment or is discriminated against based upon being regarded as having such an impairment.
Due to a student’s disability, a school may need to take some action to remove barriers thus allowing for equal access to education. Section 504 covers students, parents, and employees of institutions receiving federal financial assistance.

Section 504 Grievance Procedure
Any student, parent/guardian, or patron who believes that they have been discriminated against by or within the Middleton School District based upon disability should follow the district grievance process.
All complaints must be in writing and should be submitted to the district 504 Compliance Officer, Whitney Schexnider, 5 South Viking Avenue, Middleton, Idaho 83644. This process does not preclude informal solutions or restrict the right of the complainant to file formal complaints with state or federal agencies.
If discrimination is determined to have occurred, the district will take prompt steps to correct any effects of the discrimination and prevent further occurrence.
